Terms and Conditions

Welcome to Hireaan ("us," "we," or "our"), a recruitment CRM for hiring teams. By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please refrain from using our services.

1. Account Registration and Security

• You must provide accurate, current, and complete information when creating an account.
• You are solely responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately of any unauthorized access or use of your account.
• You may not share your account credentials with third parties.

2. Subscription and Payment

• Hireaan offers various subscription plans with different features and limitations.
• All payments are processed securely through our payment processors.
• Subscription fees are charged according to the billing cycle you select (monthly or annual).
• You may cancel your subscription at any time; however, we do not provide refunds for partial subscription periods.

3. Acceptable Use

• You agree to use Hireaan solely for legitimate hiring and recruitment purposes.
• You shall not use our platform to collect sensitive personal information beyond what is necessary for hiring decisions.
• You shall not use Hireaan for any illegal, discriminatory, or unethical hiring practices.
• You are responsible for compliance with all applicable employment and data protection laws in your jurisdiction.

3.1 Email and Candidate Outreach

Hireaan is a hiring CRM for communicating with candidates who applied to your jobs. It is not a cold outreach or bulk email tool. Sending unsolicited email through our platform harms email deliverability for every customer, and the following rules are strictly enforced.

• You may only email candidates who applied to one of your jobs, or who gave you explicit consent to be contacted about a role.
• You may not import purchased, rented, scraped, or otherwise acquired third-party contact lists.
• You may not use Hireaan to send unsolicited bulk email, cold outreach, or marketing campaigns.
• You may not impersonate any company, brand, or person in your account name, organisation name, sender name, or email content.
• You may not attempt to evade spam filters, including by disguising sender names or obscuring the nature of your messages.
• Daily sending limits apply and vary by plan. We may throttle, restrict, or queue outbound email at any time to protect deliverability for all customers.
• We may suspend or terminate an account immediately and without prior notice for violating this section. See Section 8.

3.2 WhatsApp Messaging

You can connect your own WhatsApp Business number to Hireaan through Meta's WhatsApp Business Platform. When you do, these rules apply in addition to Section 3.1.

• You may only send WhatsApp messages to candidates who authorized WhatsApp messages from your organization, through the opt-in on your application form or the authorization link. Hireaan records each authorization and blocks sending without one.
• You must comply with the WhatsApp Business Messaging Policy and Meta's terms for the WhatsApp Business Platform, including honoring every request to stop receiving messages.
• You are responsible for the content of the message templates you create, edit, or send.
• Meta charges your organization directly for WhatsApp messages. Hireaan does not resell or mark up WhatsApp messages.
• Meta may limit, restrict, or disable your number based on its quality rating or policies. We are not responsible for actions Meta takes on your WhatsApp account.
• We may disconnect your number or suspend your account for violating this section. You can disconnect your number at any time from Organization → Integrations.

4. Data and Privacy

• Hireaan collects and processes information in accordance with our Privacy Policy.
• You retain ownership of all data you upload to our platform.
• You grant us a license to store, process, and display your data solely for the purpose of providing our services.
• For candidate personal data uploaded to or generated within your Hireaan workspace, you act as the data controller and Hireaan acts as the data processor on your behalf, on the terms set out in our Data Processing Addendum (DPA), which is incorporated into these Terms by reference. • You are responsible for obtaining proper consent from job applicants for collecting and processing their information, and for providing them with notice of how their data will be processed.
• When you connect Google services (Gmail, Calendar, Forms), you authorize Hireaan to access and use those services on your behalf as described in our Privacy Policy. You can revoke this access at any time through your account settings.
• When you connect a WhatsApp number, you authorize Hireaan to send and receive messages and manage message templates on your behalf through Meta's WhatsApp Business Platform, as described in our Privacy Policy. You can revoke this access at any time by disconnecting the number.
• When you import candidates from Google Forms, you represent that you have the right to collect and process the applicant data contained in those form responses. Hireaan is not responsible for the content of your Google Forms or the data submitted by applicants.

5. Intellectual Property

• All content, features, and functionality of Hireaan, including but not limited to text, graphics, logos, and software, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
• You may not reproduce, distribute, modify, or create derivative works of our platform without our express written permission.

6. User Content

• You retain all rights to the content you upload to our platform.
• You grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving our services.
• You represent and warrant that you have all necessary rights to the content you upload and that such content does not infringe upon any third-party rights.

7. Service Availability and Modifications

• We strive to ensure Hireaan is available at all times, but we do not guarantee uninterrupted access.
• We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
• We may update these terms as needed. Continued use of Hireaan after changes constitutes acceptance of the updated terms.

8. Termination

• We reserve the right to suspend or terminate your access to Hireaan if you violate these terms.
• You may terminate your account at any time by contacting us or using the account deletion feature.
• Upon termination, you will lose access to all data stored on our platform. We recommend exporting your data before account termination.

9. Limitation of Liability

• To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use Hireaan.
• Our total liability for all claims related to these terms shall not exceed the amount you paid to us for the service during the 12 months preceding the claim.

10. Indemnification

• You agree to indemnify and hold harmless Hireaan, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use of our platform or violation of these terms.

11. Governing Law

• These terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law principles.
• Any dispute arising from these terms shall be resolved exclusively in the courts of the Federal District, Brazil.
